KC’s Aussies Health Guarantee & Puppy Sales Contract
KC’s Aussies, owners of the said puppy/dog (described below) hereafter referred to as “Seller” do enter into an agreement with, _____________________________ hereafter referred to as “Buyer”, for the purpose of transferring ownership of the said puppy. The said puppy is a purebred Australian Shepherd, sired by__________________________ and out of _____________________________. The puppy/dog is a ___________. The said puppy/dog’s date of birth is _____________________, and registers with AKC and/or ASCA. Registration papers will be transferred at the time of sale after full payment has been made. The seller will transfer ownership of the said puppy for $______________ , with limited registration, unless otherwise agreed upon by both parties. A deposit of $_____________was paid to hold this puppy/dog and the balance of $______________is due at time of pick-up or before.
Guarantees: KC’s Aussies guarantees the puppy/dog to be free of major diseases such as: Parvo, Distemper, Corona, and Rabies for a period of 24 hours from the date of sale as stated on the Pet’s Records. We also recommend that you take your new puppy to your own personal vet within the first 72 hours of pick-up. KC’s Aussies also guarantees this puppy/dog to be free of genetic defects that can be tested for in the Australian Shepherd genetic panel until the puppy/dog is 2 years old. If the puppy/dog is found to have a genetic defect it will be replaced with another puppy of the same sex from the first compatible litter. No money will be refunded unless agreed upon by both parties. Buyer is responsible for the shipping costs of the replacement puppy. We are NOT responsible for any Vet/Medical bills incurred by the buyer. If your puppy displays any indication of poor health within the first 24 hours, we must be contacted and the puppy/dog must be brought back or taken to our veterinarian for any necessary testing and treatment. Puppies that go out of state must go to a licensed veterinarian, and signed documentation must be forwarded to us immediately. Failure to do so will cause this guarantee to become null and void. Shipping of Puppy: Puppies are shipped at 8 weeks of age and will be guaranteed for up to 72 hours from shipping date. The puppy/dog will be up to date on their shots/several wormings/vet health certificate. Along with the price of the puppy/dog the buyer will be responsible for shipping fees. Also, in the event of a replacement puppy buyer is responsible for the shipping fees. KC’s Aussies shall not be responsible for death or injury of said puppy/dog due to negligence or carelessness of the buyer. Breeder makes no guarantees regarding the loss of the puppy due to an accidental death, theft, sickness due to lack of vaccinations, etc., or any other loss beyond the breeders control except as stated above. Breeder will NOT refund money in whole or part for any reason other than stated in the guarantee. Also, this guarantee shall become null and void if the puppy/dog is given any vaccinations or medications other than what is specified on the medical records received with the puppy/dog.
***KC’s Aussies does not guarantee eye color, ear set, conformation, disposition and/or breeding ability. *** The health guarantee does NOT cover any parasite, internal or external, as this is a treatable condition. Return If at any time for any reason the buyer can not keep said puppy/dog the Buyer agrees to contact the Seller and offer the said puppy/dog back to the Seller. All deposits are NON-Refundable...all family members must be in agreement in regards to getting a pet. We do NOT refund deposits or purchase price due to family members with allergies, or your lease and/or HOA not allowing pets or for any other reason. These are all things that should be considered prior to placing a deposit or purchasing one of our puppies/dogs. I acknowledge that this is a legal and binding contract and have reviewed and agree to the terms listed above. The Buyer also agrees to use the name “KC’s” as the prefix in the registered name of the puppy/dog. The buyer will also maintain up to date vaccines, wormings, and keep the puppy/dog in humane conditions and provide proper food, water, and shelter. Failure to follow the above contract completely will result in “A Breach of Contract” and shall make this contract null and void. This contract applies only to the original buyer and is NOT transferable. When a deposit is received by KC’s Aussies the buyer automatically agrees to the terms of this contract, even if both the breeder and the buyer have not yet signed the contract.
